Welcome to Motardia. These Terms of Service ('Terms') govern your access to and use of the Motardia mobile app and the motardia.com website ('the Service'). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service. For any question, contact us at dyayoub@gmail.com.
1. Eligibility & accounts
You must be at least 13 years old (or the minimum age required in your country) to use Motardia. You are responsible for the information you provide, for keeping your login credentials secure, and for all activity under your account. Provide accurate information and keep it up to date. Notify us at dyayoub@gmail.com of any unauthorized use.
2. The Service
Motardia is a community platform for motorcycle and quad/ATV riders. It lets you organize and join group rides, publish and browse marketplace listings, message other members, share content on a social feed, and manage a rider profile. We may add, change or remove features at any time.
3. Acceptable use
When using Motardia you agree NOT to: • Break the law or encourage others to. • Harass, threaten, defame or harm other users. • Post hateful, violent, sexual, or otherwise inappropriate content. • Spam, scam, phish, or post misleading information. • Upload content you don't have the right to share, or that infringes others' rights. • Attempt to hack, overload, scrape, or disrupt the Service. • Impersonate others or create fake accounts. We may remove content and suspend or terminate accounts that violate these rules.
4. Your content
You keep ownership of the content you post (listings, photos, videos, posts, comments, messages, reviews). By posting, you grant Motardia a non-exclusive, worldwide, royalty-free license to host, store, display and distribute that content as needed to operate the Service. You are solely responsible for your content and confirm you have the rights to share it.
5. Rides
Rides are organized by users, not by Motardia. We do not verify, supervise, or take part in any ride. You join and participate entirely at your own risk. You are responsible for your own safety, your vehicle, your insurance, your equipment, and compliance with traffic laws. Motardia is not liable for any accident, injury, loss or damage arising from rides organized or joined through the Service.
6. Marketplace
The marketplace lets users list and discover items. Motardia is only a platform — it is not the seller, buyer, or a party to any transaction. We do not own, inspect, guarantee, or handle payment for listed items. All negotiations, payments and exchanges happen directly between users, at their own risk. Meet in safe public places, verify items before paying, and use caution. Motardia is not responsible for the quality, legality, safety, or delivery of any item, nor for any dispute, loss or fraud between users.
7. Prohibited items & content
Do not list or share illegal, stolen, counterfeit, dangerous or prohibited items, or anything you are not legally allowed to sell. We may remove any listing or content at our discretion.
8. Intellectual property
The Motardia name, logo, app and website (excluding user content) are owned by Motardia and protected by applicable laws. You may not copy, modify, or reuse them without our permission.
9. Third-party services
The Service relies on third parties such as Google (Sign-In), map data providers, Microsoft Azure (hosting) and Firebase (notifications). Their terms and policies also apply. We are not responsible for third-party services.
10. Disclaimers
The Service is provided 'as is' and 'as available', without warranties of any kind. We do not guarantee that it will be uninterrupted, error-free, or secure, or that content posted by users is accurate or reliable.
11. Limitation of liability
To the maximum extent permitted by law, Motardia is not liable for indirect, incidental or consequential damages, or for any loss arising from rides, marketplace transactions, user content, or your use of (or inability to use) the Service. Nothing in these Terms limits liability that cannot be excluded by law.
12. Suspension & termination
You may stop using the Service and delete your account at any time (Settings → Delete account). We may suspend or terminate your access if you violate these Terms or to protect users or the Service. On termination, your right to use the Service ends.
13. Changes
We may update the Service and these Terms. For material changes we will provide notice in the app or on the website and update the 'Last updated' date. Continued use after changes means you accept the updated Terms.
14. Governing law
These Terms are governed by applicable law. Mandatory consumer-protection rules of your country of residence still apply. Disputes will be handled by the competent courts.
